Privacy Policy

Panasonic Manufacturing Malaysia Berhad (Company Registration No. 196501000304 [6100K]) (“Company”, “we”, “our”, “us”) respects and is committed to protecting your Personal Data (as defined below). 

This document (“Privacy Policy”) explains our policy on how we collect and handle Personal Data of visitors to our website and premises (“you”, “your”) in accordance with the Malaysian Personal Data Protection Act 2010 including any amendments thereto (“PDPA”) and the applicable laws and regulations.

This Privacy Policy applies to our online (such as websites, applications, third party social networks or our online events) and offline (such as physical events, or through other third parties that we work with) collection activities, including Personal Data and information in any form, whether electronic or written.

By accessing our website or premises, interacting with us and/or submitting Personal Data to us, you agree and consent to us, as well as our authorized representatives and/or agents the collection, usage, processing, sharing and storing of your Personal Data, and disclosure of such Personal Data to Relevant Third Parties (as defined below) in the manner set forth in this Privacy Policy.

The provision of your Personal Data is voluntary. However, if you do not wish to provide your Personal Data or insufficient Personal Data is supplied to us, we may not be able to communicate with you and/or process your request effectively. Further, you agree that we shall not be held liable for any of the consequences arising from the non-provision of your Personal Data.

SCOPE OF PERSONAL DATA

1.1.

In this Privacy Policy, “Personal Data” means any information which relates to you that is collected or processed by us directly or indirectly for the Purposes (as defined below) stated in Section 3 below.

1.2.

Examples of Personal Data that we may collect from you including but not limited to: –

a)

Personal details – any information you provide to us that would allow us to identify and contact you, such as your name, National Registration Identity Card/Passport number, address, contact details (such as mobile number, residential telephone number and email address);

b)

Demographic details – any information that describes your demographic or behavioral characteristics, such as your date of birth, age, race, ethnicity, gender, marital status, income, profession, education level;

c)

Information from computer/other technology devices – any information about the computer system or other technological devices that you use to access our website, such as your Internet Protocol (IP) address, website movements, browser type, operating system and Uniform Resource Locators (URL) information;

d)

Websites/communication usage information – as you navigate through and interact with our website or newsletters, we use automatic data collection technologies to collect certain information about your actions, such as which links you click on, which pages or content you view and for how long, and other similar information and statistics about your interactions (please refer to Section 6 below for more details on what Personal Data we obtain when you visit our website);

e)

Photographs or videos – any photographs or videos of you taken or recorded during your visit to our premises or events; and/or

f)

Personal Data of children and young people – we do not knowingly solicit or collect Personal Data from children below the age of 18. If we discover that we have unintentionally collected Personal Data from a child below the age of 18, we will remove that child’s Personal Data from our records promptly. However, we may collect Personal Data about children below the age of 18 from the parent or guardian directly, and with that person’s explicit consent. In these situations, you confirm that they have appointed you to act for them and to consent on their behalf to processing their Personal Data in accordance with this Privacy Policy.

1.3

If you provide to us with Personal Data of anyone other than yourself, please make sure you have their prior consent to provide us with their Personal Data and they understand how we collect, use, process, share, store and disclose Personal Data as set out in this Privacy Policy.

1.4

Personal Data requested from us are the minimum required to administer any arrangement or contractual relationship in place between you and us. In certain circumstances, it may be mandatory under the law for you to provide us with your Personal Data. In other circumstances, your decision to provide any Personal Data to us is voluntary. However, failure to consent to the collection, processing, storing and disclosure of the Personal Data may affect your application/request and/or our ability to perform our obligations under any applicable laws, as the case may be.

Although we try to provide reasonably adequate information concerning our policy relating to Personal Data, this Privacy Policy is not an exhaustive list of all situations or scenarios concerning Personal Data. Please approach us if you need clarification about a specific situation.

COLLECTION OF PERSONAL DATA

2.1.

We may collect Personal Data from you in a variety of ways, such as where you voluntarily: –

a)

visit our website (please refer to Section 6 below for more details on what Personal Data we obtain when you visit our website);

b)

interact through our website (such as when you contact us via our website);

c)

interact with our authorized representative via telephone, letter, fax, face-to-face meetings, social media platforms and emails;

d)

apply to us or one of our Affiliates (as defined below) for a job;

e)

request for further information or documents (such as Annual Report);

f)

enter our premises or attend our events or meetings or activities (such as Annual General Meeting or vendors/suppliers/business partners’ meeting) whereby your images are captured via Closed Circuit Television (CCTV) cameras, or via photographs or videos taken by us or our authorized representatives;

g)

submit any forms to us; and/or

h)

submit Personal Data to us for any other reasons.

2.2.

You shall ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure on your part to do so may result in our inability and/or delay in providing you with the information you have requested, or in responding to your queries, or processing any requests submitted to us.

PURPOSES AND DISCLOSURE

3.1.

Generally, your Personal Data may be collected, used and processed by the Company, our affiliates in the Panasonic Group, within or outside Malaysia (“Affiliates”) or Relevant Third Parties for the following purposes (“Purposes”): –

a)

General administration and management such as business process execution, internal management, management reporting, identity verification, surveys and information technology communications to enable us to perform our proper functions, comply with record keeping, crime prevention, audits, investigations, dispute resolution or insurance purposes, litigation and defence of claims and other legal obligations;

b)

Health, safety and security such as implementing safety and security measures, protection of your health and safety, protection of Company’s assets and authentication of your status and access rights; and/or

c)

Legal and/or regulatory compliance such as compliance with legal or regulatory requirements.

3.2.

All Personal Data may be processed by and/or disclosed to our Affiliates and/or Relevant Third Parties within or outside Malaysia (i) for the Purposes set out in this Section 3.1 above, (ii) as required under law, (iii) pursuant to relevant contractual relationship (for example, service providers), or (iv) in the event of corporate transactions such as potential, proposed or actual sale or disposal of business or interest, acquisition, merger and re-organization.

3.3.

Examples of “Relevant Third Parties” including but not limited to: –

a)

governmental agencies and statutory authorities, industry regulators, law enforcement agencies, local councils;

b)

potential or actual successors-in-title of the Company’s business or share; and

c)

third parties (including agents, advisors, representatives and contractors) appointed or engaged by the Company and/or our Affiliates to facilitate, perform or implement the Purposes in Section 3.1 above (such as lawyers, auditors, company secretary, tax agents and other professional consultants, telecommunications companies, insurance companies, financial institutions, as well as service providers and suppliers (such as event organizers, printing companies, suppliers of information technology system, solutions and software)).

4.

PROTECTION AND RETENTION OF PERSONAL DATA

4.1.

Access to your Personal Data is restricted to authorized persons on a need-to-know basis in accordance with Panasonic’s Global Information Security Management (ISM) Common Guidelines. Such access is controlled through various administrative, physical and technical measures such as compliance training, locked cabinets, secured network and data encryption.

4.2.

We ensure that Relevant Third Parties protect your Personal Data through contractual obligations, audits and/or certification of administrative, physical and technical measures.

4.3.

The Company may retain your Personal Data for as long as the fulfillment of the Purposes stated above in Section 3.1 is required, or if such retention is necessary pursuant to any legal, regulatory or accounting requirements (in which case it will be disposed once no longer required for the legal or regulatory purpose).

5.

TRANSFERS AND PROCESSING OUTSIDE MALAYSIA

Your Personal Data may be transferred to and/or processed outside Malaysia by our Affiliates or Relevant Third Parties for the Purposes set out in Section 3.1 above. We review these overseas transfers and processes to ensure that your Personal Data is protected in accordance with the requirements of the PDPA. We do this by: (i) incorporating these requirements as contractual obligations for transfers, and (ii) implementing Panasonic’s Global Information Security Management (ISM) Common Guidelines and applicable corporate rules for transfers between us and our Affiliates in the Panasonic Group.

6.

WEBSITES

6.1.

Links to other sites – links to other sites are provided for your convenient and information. These sites may have their own privacy statement in place, which we recommend you to review if you visit any linked websites. We are not responsible for the content on the linked sites or any use of the site.

6.2.

Location enabled products or applications

a)

Location enabled products or applications transmit your location to us. We do not use the information sent or provided other than to provide the service you request. Location enable features are opt-in and you have control over your participation and can turn these services off at any time or uninstall them.

b)

Some mobile applications will utilize Google Analytics (or similar tool) to help us better serve you through improved products, services and revisions to the mobile applications. This collected information will not identify you to us. It may, however, let us know anonymously, which services and features you are using the most within the application, as well as device type and hardware features, country and language of download.

6.3.

Cookies and similar technologies

a)

When you interact with us on our website, we or our authorized service providers may use cookies for collecting and storing information to assist in providing you with a better, faster and safer web experience.

b)

The information collected by us or our authorized service providers may recognize a return visitor as a unique visitor and may collect information such as: (i) how a visitor arrives at our site, (ii) what kind of browser a visitor is on, (iii) what operating system a visitor is using, (iv) a visitor’s IP address and (v) a visitor’s click stream information and time stamp (for example, which pages they have viewed, the time the pages were accessed and the time spent per web page).

c)

Cookies are small text files (typically made up of letters and numbers) placed in the memory of your browser or device when you visit a website. Cookies allow a website to recognize a particular device or browser.

d)

The use of cookies, by us or our website is necessary for the functioning of our services, to help us improve our performance, or serve to provide you with extra functionalities. They may also be used to deliver content that is more relevant to you and your interests, or to target advertising to you on or off our site.

e)

Should you wish to disable the cookies associated with these technologies, you may do so by changing the setting on your browser. However, if you decline cookies, you may not be able to take advantage of certain site features or services tools.

RIGHT TO ACCESS, CORRECTION AND WITHDRAWAL

7.1.

You are responsible for reviewing and updating the Company any changes to your Personal Data to ensure that the information which you have disclosed is correct and up to date. You may access and correct your Personal Data held by the Company (subject always to certain exemptions) electronically or notifying us directly via the contact details set forth in Section 8 below.

7.2.

Kami berhak untuk meminda atau mengubahsuai Polisi Privasi ini dari masa ke semasa untuk menunjukkan sebarang perubahan dalam cara kami mengendalikan Data Peribadi anda atau sebarang perubahan dalam undang-undang yang terpakai dan versi yang dikemaskini akan terpakai dan menggantikan mana-mana dan semua versi terdahulu. Penerusan komunikasi anda dangan kami atau penerusan penggunaan laman web kami berikutan pindaan, pengubahsuaian atau kemaskini Polisi Privasi ini, menandakan penerimaan anda terhadap pindaan, pengubahsuian atau kemaskini tersebut.
